MedHQ is a medical practice management platform ("MedHQ", "we", "our", or "us"). By accessing or using MedHQ's medical practice management platform ("Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

MedHQ provides a cloud-based medical practice management platform that includes appointment scheduling, patient records management, clinical documentation, billing, and related features for healthcare professionals.

3. User Accounts

When you create an account with us, you must:

• Provide accurate, complete, and current information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorised access

4. Professional Responsibility

You acknowledge that MedHQ is a practice management tool and does not provide medical advice. You remain solely responsible for:

• All clinical decisions and patient care
• Compliance with applicable healthcare regulations
• Maintaining appropriate professional registrations and licences
• The accuracy of patient records and clinical documentation
• Obtaining necessary patient consents

5. Data Protection and Confidentiality

You are responsible for ensuring that your use of the Service complies with the Protection of Personal Information Act (POPIA) and any other applicable data protection legislation. You must ensure appropriate consent is obtained from patients before entering their information into the system.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service or servers
• Transmit any malicious code or harmful data
• Resell or redistribute the Service without authorisation

7. Intellectual Property

The Service and its original content, features, and functionality are owned by MedHQ and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any data you enter into the system.

8. Service Availability

While we strive to maintain high availability, we do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will endeavour to provide advance notice of planned maintenance.

9. Limitation of Liability

To the maximum extent permitted by law, MedHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless MedHQ and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
